01Acceptance of Terms
These Terms of Service (“Terms”) govern your use of Upstart Blogger (“we”, “us”), including the website, your account and any content you publish. By creating an account, activating an account carried over from the previous Upstart Blogger site, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service.
- You must be at least 16 years old to create or activate an account.
- Give accurate information, keep your password private, and tell us promptly if you think your account has been compromised. You're responsible for activity under your account.
- One person per account. Accounts may not be sold or transferred.
- Migrated accounts: accounts and stories from the previous site were carried over to this platform. When you activate a migrated account by setting a new password, these Terms replace any terms that applied on the previous site, from that point on.
02User-Generated Content & Intellectual Property
You own what you write. Stories, comments, images and other material you submit (“your content”) remain yours. We don't claim ownership of it.
To run the service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for display (for example resizing images, creating excerpts, previews and share cards), publish and distribute your content on Upstart Blogger and in the places it is surfaced from here, such as search engines, link previews and feeds. This license is only for operating, displaying and promoting the service and your work.
The license ends when you delete your content or your account, except for copies held for a limited time in backups, copies we must keep by law, and content that others have already shared or cached outside the service.
- You confirm you have the rights to everything you publish, including images, quotes and trademarks, and that it doesn't infringe anyone else's rights.
- You're responsible for your content and for any claims it gives rise to.
- We may remove or restrict content that breaks these Terms or the law, and we aren't obliged to host any particular content.
- If you believe content on Upstart Blogger infringes your copyright, contact us with the work, where it appears on our site and your contact details, and we'll review it promptly.
The Upstart Blogger name, logo, site design and software belong to us and may not be copied or reused without permission.
03Acceptable Use & Anti-Spam Guidelines
Upstart Blogger is a place for real writing and real conversation. You agree not to:
- Automate the service: create accounts, post, comment or vote with bots, scripts or other automated means, or try to get around our security checks (such as reCAPTCHA) or rate limits.
- Scrape it: harvest content, profiles or email addresses in bulk. Search engines that follow our robots.txt are welcome.
- Spam: drop links in comments to promote sites, products or affiliate offers; post repetitive or off-topic messages; or take part in link schemes meant to manipulate search rankings.
- Mislead: hide affiliate or sponsored relationships, impersonate others, or use deceptive links, redirects or cloaking. Affiliate links in your own stories are fine when they're clearly disclosed.
- Publish anything illegal, or content that harasses, threatens or promotes hatred against people, or exposes someone's private information.
- Distribute malware or phishing, or probe, test or attack our systems without written permission.
To keep spam out, comments with several links or with link markup are held for review or filed as spam automatically. If you break these rules we may hold, remove or limit your content, suspend or ban your account, or delete it, depending on how serious the problem is.
04Suspension & Account Closure
You can stop using Upstart Blogger at any time, and you can ask us to delete your account through the Help Center. Deleting an account removes your profile, stories and comments. We may suspend or close accounts that break these Terms or put other people or the service at risk, and where reasonable we will tell you why.
05Links & Third-Party Services
Stories and comments often link to other websites, and some features rely on services run by other companies. We don't control those sites or services and aren't responsible for their content, products or practices. Following an external link is at your own risk.
06Disclaimers & Limitation of Liability
Upstart Blogger is provided “as is” and “as available”. We work to keep it running and your content safe, but we don't promise that it will be uninterrupted, error-free or free of data loss. Hosting, network and third-party outages can happen. Please keep your own copies of anything important.
Content on the platform is written by its authors and doesn't represent our views. We don't verify it and aren't responsible for it, or for websites it links to.
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars.
Some places don't allow these exclusions or limits, so they may not all apply to you.
07Changes to These Terms
We may update these Terms as the service grows. When we make a significant change we'll update the date at the top and, where appropriate, let you know by email or on the site before it takes effect. Continuing to use Upstart Blogger after that means you accept the updated Terms.
